Neutral Citation No. - 2025:AHC:22779-DB Court No. - 29 Case :- WRIT - C No. - 3649 of 2025 Petitioner :- Rc Jewellers Pvt Ltd Respondent :- State Bank Of India And Another Counsel for Petitioner :- Naman Agarwal,Gunjan Jadwani Counsel for Respondent :- Satish Chaturvedi Hon'ble Ashwani Kumar Mishra,J. Hon'ble Vipin Chandra Dixit,J. Petitioner wants a direction from this Court to the respondent Bank to release a sum of Rs.4,60,000/- allegedly withheld from the petitioner's bank account No.000000403388401. Sri Pankaj Srivastava, learned counsel appearing for the Bank, on the basis of instructions, states that the Bank has withheld the amount on the instructions of Cyber Cell in respect of criminal case, reference of which is given in the Annexure-7 to the writ petition. Once the Investigating Authority has seized the account and the Bank has acted consequent upon the such direction, the remedy of the petitioner would be to approach the concerned Magistrate for release and no writ would be issued for such purposes, at the first instance. Leaving it open for the petitioner to pursue the remedy before the concerned Magistrate, this writ petition is consigned to records.
