Mohi-ud-Din Mir v. Reyaz Ahmad Bhat”, whereby Tehsildar Keegam was directed and authorized to proceed with the attachment of the property of the accused, value the attached property as per market value, publish a public notice and sell that part from identified attached property which shall be sufficient to satisfy the outstanding amount through public auction, and proceeds from the sale shall be utilized to recover the outstanding amount of Rs.8,50,000/- and also report to the court outlining the actions taken, amount realized from sale and the method of distribution of the recovered amount. This Court vide order dated 04.06.2025, directed the petitioner to surrender before the Trial Court by or before the next date of hearing and only thereafter, matter would be considered. However, petitioner has not surrendered before the Trial Court, therefore, this petition is dismissed.
