The petitioner has been made accused in connection with S.T. Case No.211 of 2024 arising out of Chandil (Kapali) P.S. Case No.137 of 2024 corresponding to G.R. No.346 of 2024 registered under Section 109, 302, 120B and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that petitioner, in furtherance of common intention with the co-accused persons, has committed the murder of the husband of the informant namely Amjad Ali. It is submitted that the allegation against the petitioner is false and general and omnibus in nature. It is further submitted that charge has already been framed in this case but no witness has been examined as yet. It is next submitted that the co-accused, with similar allegations, have already been released on bail by a co-ordinate Bench of this Court vide common order dated 11.02.2025 passed in B.A. No.10107 of 2024 with B.A. No.10124 of 2024. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the informant in any manner during the pendency of the trial. It is lastly submitted that the petitioner has been in custody since 19.06.2024 as is evident from para-15 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Chandil in connection with S.T. Case No.211 of 2024 arising out of Chandil (Kapali) P.S. Case No.137 of 2024 corresponding to G.R. No.346 of 2024 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant in any manner during the pendency of the trial.
