There are factual issues as to whether sufficient land exists over Arazi No.166 which is recorded for the village panchayat. The State authorities are proposing to construct panchayat bhawan on plot no.90 which is barren and vests in the State. 2. Learned counsel for the petitioner submits that the panchayat bhawan is being constructed on plot no.90 and not on plot no.166 only because of malicious approach of the village Pradhan who wants the panchayat bhawan to be constructed close to his house. 3. Such issues of fact can always be got examined by the concerned State authorities. 4. In such circumstances, we disposed of this writ petition with liberty to the petitioner to approach the second respondent who will get the facts determined and would take appropriate decision with regard to location of the proposed panchayat bhawan to be constructed in the gram panchayat Dubkia, Block Chiraigaon, District Varanasi.
