Heard learned Standing Counsel for the State-respondents and perused the record. 2. The instant writ petition has been filed for the following relief: "(i). Issue an order or direction to direct the court below/Sub Divisional Magistrate Chandausi, District Sambhal to decide the restoration application dated in 16.2.2023 passed in Contempt Application No.2 of 2021 (Mohd. Akhtar Versus Laika Begum and others) within stipulated time bound period or as directed by this Hon'ble Court." 3. From the perusal of the writ petition and annexures annexed thereto, it appears that the restoration application is pending since 16.02.2023 and several dates have been fixed by the Court concerned, however, till date, the same has not been decided. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Sub Divisional Magistrate Chandausi, District Sambhal to consider and decide the restoration application, in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after ensuring service upon the opposite parties as well as giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided there is no other legal impediment.
