This Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 to quash the entire proceedings of Criminal Case No.890 of 2024, “State vs. Shubham Rawat”, pending before the court of IInd Additional Judicial Magistrate, Haldwani, District Nainital under Sections 354, 504, 506, 333 and Section 353 of the Indian Penal Code, 1860. 2. Heard Mr. Abhishek Joshi, learned counsel for the applicant, Mr. Sandeep Sharma, learned Assistant Government Advocate for the respondent no.1 and Ms. Reema Rana, learned counsel for the respondent no.2. 3. Applicant-Shubham Rawat is present in-person. 1 2025:UHC:7603 He is identified by Mr. Abhishek Joshi, Advocate. 4. The respondent no.2/informant/victim is present in-person. She is identified by Ms. Reema Rana, Advocate. 5. Both, the applicant and the private respondent no.2 submitted that they have settled their private disputes amicably and reached to a compromise pursuant to which, they have filed a Compounding Application (IA No.01 of 2025) and affidavits. They submitted that they have filed the compounding application and affidavits with their free will and without any pressure. The respondent no.2 requested to quash the entire proceedings of Criminal Case No.890 of 2024. 6. Learned counsel for the State submitted that the parties have settled their private disputes amicably, therefore, the State has no objection to the submissions of the applicant and the respondent no.2. 7. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.890 of 2024, “State vs. Shubham Rawat”, pending before the court of IInd Additional Judicial Magistrate, Haldwani, Nainital, are quashed. 8. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2 2025:UHC:7603 2023 is allowed and the entire proceedings of Criminal Case No.890 of 2024, “State vs. Shubham Rawat”, pending before the court of IInd Additional Judicial Magistrate, Haldwani, Nainital, are hereby quashed. ___________________ Date: 27.08.2025 ALOK KUMAR VERMA, J.
