The present petition has been filed seeking to assail the order dated 07.02.2024 passed by the respondent No. 2, the Additional Commissioner (Administration) Jhansi Division, Jhansi, in Revision No.-92/204 (Computerized Case No. C202406000000092) [Prakash and Others Vs. Rajwati and Others], under Section 210 of the U.P. Revenue Code, 2006, filed against the order dated 29.12.2023, passed by the respondent No. 3, the Sub Divisional Magistrate (Judicial), Mahrauni, Lalitpur, in Appeal No. 1035 of 2023 (Computerized Case No. T202306450301035 [Rajwati Vs. Prakash], under Section 35(2) of the U.P. Revenue Code, 2006, in terms of which the revision has been rejected on the ground that the order in question against which the revision had been preferred was a remand order and was of an interlocutory nature. The remand order dated 29.12.2023 is also sought to be challenged. Counsel for the petitioners after making submissions to some extent has not disputed the fact that the order dated 29.12.2023 was a remand order and of an interlocutory nature, and accordingly the reasoning given by the revisional court cannot be said to suffer from any error. Counsel for the petitioners, accordingly states that he does not wish to press the petition and that the petitioners would contest the proceedings before the court concerned, where the matter is now pending.
