The cases lodged against the Petitioners are under the Provisions of Andhra Pradesh Protection of Depositors of Financial Establishments Act. Petitioners/A.54 to A.7 are the registered Directors of A.l Company which is having its registered office at Hyderabad. The main allegations are that the company collected deposits from the depositors and did not return the matured amounts to them. Different complaints were lodged by the depositors. Police after completion of investigation, filed different charge sheets in connection with the respective Crimes registered against the Petitioners along with other accused. Seeking quashment of Proceedings, these Criminal Petitions are filed. Heard learned counsel for the Petitioners and learned Special Public Prosecutor for CID. Perused the material on record. Learned counsel for the Petitioners would submit that there are no ingredients to attract the alleged offences against the Petitioners and prays for quashments of the proceedings against them. Learned Special Public Prosecutor would submit that Court may pass appropriate orders. A bare perusal of the contents of the charge sheet and the material placed on record would clearly go to show that there are money transactions between the parties with regard to the investment of the money in A.l /company. The allegations raised against the Petitioners involve disputed factual aspects, which cannot be decided while exercising the jurisdiction under Section 10 482 Cr.P.C. The truth or otherwise of the said allegations have to revealed during trial. Further, a fair look at the complaints would disclose the ingredients of offences alleged against the Petitioners. The Court cannot conduct a mini trial while deciding a petition filed under Section 482 Cr.P.C. There are no merits in the contentions raised by the Petitioners to quash the proceedings against them and hence, the Criminal Petitions deserve dismissal. Without causing prejudice to the rights and contentions of the parties, these Criminal Petitions are disposed of. Petitioners are at liberty to raise such contentions before the Trial Judge and the Learned Trial Judge shall appreciate such contentions of the Petitioners at their defence and pass appropriate orders according to law.
