Heard Sri Parvish Kumar, learned counsel for the petitioner and Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State-respondents. Present petition has been filed seeking to raise a grievance with regard to encroachment of chakroad/common pathway which is stated to be reserved for the purpose of ingress/egress, bearing arazi nos.883 and 738Ka, situate in Village Daha, Tehsil Baraut, District Baghpat. It is not disputed that for redressal of the aforestated grievance, the petitioner would be required to initiate appropriate proceedings under the UP Revenue Code, 2006, and in view thereof, this Court is not inclined to entertain the writ petition. Accordingly, learned counsel states that he does not wish to press the petition and that the petitioner would take recourse to the appropriate statutory legal remedy with regard to his grievances.
