Also heard Mr. P. Bortharkur, learned Additional Public Prosecutor for the State respondent. This application is filed under Section 482 of the BNSS, praying for the grant of pre-arrest bail to the petitioner in connection with Dispur P. S. Case No. 1153/2024 corresponding to G. R. Case No. 6317/2024, under Section 306 of BNS. The Case Diary has been received and I have perused the same. It is submitted by Laskar, learned counsel for the petitioners that after obtaining interim pre-arrest bail, the accused/petitioners appeared before the I.O. and recorded their statement under Section 183 of the BNSS and cooperated in the investigation of the case. He further submits that the petitioners are still ready and willing to cooperate with the I.O. in the further investigation of this case, if the interim pre-arrest bail order is made absolute. Mr. Borthakur, learned Additional Public Prosecutor, submits that the accused/petitioners, after obtaining interim pre-arrest bail, have indeed cooperated with the investigation and their statements under Section 183 BNSS have been duly recorded. He further submits that, in view of their cooperation, further custodial interrogation may not be necessary. Having heard the submissions of the learned counsel for both sides, and upon perusal of the materials available in the Case Diary as well as the conduct of the accused/petitioners during the investigation, I find it appropriate to allow Page No.# 3/3 the prayer made by the petitioners. Accordingly, the interim pre-arrest bail granted to the accused/petitioners vide order dated 09.04.2025 is hereby made absolute, on the same terms and conditions.
