...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction particularly one in the nature of Writ of Mandamus declaring that the action of the Respondents University in not sanctioning petitioners the pay scale attached to the post of Electrician qualified viz., Rs. 17,890/ in the Revised Pay Scales of 2015 as per rules and further declaring that petitioners are entitled to be given the pay scale meant for qualified Electrician from the date when they were extended the benefit of payment of pay scale with all consequential benefits and pass such other
order or orders.
IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to release the petitioners the pay attached to the post of qualified Electrician viz., Rs. 17,890/ in the Revised Pay Scales of 2015 pending disposal of the Writ Petition and pass such other order or orders. ORDER:
Learned Standing Counsel for respondents 2 and 3, filed counter and stated that the representations of the petitioners to consider their academic and technical qualification to fix their pay scale as per the Revised Pay

Scales, 2015, were considered. Learned Standing Counsel would further submit that the petitioners were paid the revised pay scales from October,
2019.
2. For ready reference, the relevant portion in the counter, is extracted hereunder:
“.......as claimed by the petitioners we humbly state that the representations have been received from petitioners to consider their academic and technical qualifications and to fix the pay scale as per Revised Pay Scales, 2015. In this regard, I respectfully submit that the university favorably considered their request in the interest of their welfare and accordingly made provisions in the budget for their payment of scales as per Revised Pay Scales, 2015. Accordingly, they were paid Rs.17890/- with effect from October, 2019 and relevant proof is appended for your kind perusal. Therefore, we respectfully state that the university has no intention to harm their interests and discriminate them and as such the pay scale earlier paid as per Executive Council Resolutions.”

Learned counsel for the petitioners would submit that recording the same, the writ petition may be disposed of.
4. Recording the same, the Writ Petition is disposed of. There shall be no
order as to costs.
