The present petition has been filed seeking to assail the orders dated 12.03.2024, 07.12.2023 and 05.07.2023, arising out of proceedings under Section 35 of the U.P. Revenue Code, 2006. Counsel for the State respondents has pointed out that the proceedings under Section 35 of the U.P. Revenue Code, 2006, are summary in nature and as per the settled legal position, a writ petition would not be entertainable to challenge the orders passed in the said proceedings. Counsel for the petitioners has not disputed the aforesaid factual and legal position. Accordingly, learned counsel states that he does not wish to press the petition and that the petitioners would avail the appropriate legal remedy to seek declaration of their rights.
