GP FOR HOME (AP) 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 7345 of 2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate writ , order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the notice issues by the 5th respondent in C.No.2/RI- DSW/KDP/2020, dated 12.02.2020, where under the security provided to the petitioner was reduced from 4 plus 4 to 2 plus 2, without any prior notice or intimation, being arbitrary, discriminatory, contrary to the security earlier provided basing on threat perception as the petitioner is a crucial witness in Obulapuram mining case and as per the reference made by Central Bureau of Investigation (C.B.I.), Anti Corruption Zone, Hyderabad and offends Articles 14 and 21 of Constitution of India, as bad, illegal, arbitrary, without any notice, violation of principles of natural justice, and consequentially to set aside the same with a direction to the respondent to restore back 4 plus 4 PSO security round the clock at the cost of states, during the stay at Kadapa, while moving to other districts and states as provided earlier and to pass such other order or orders as Hon'ble court may deem fit and proper in the circumstances of the case and consequentially to direct the respondents 2 to 5 to restore back 4 plus 4 PSO security to the petitioner by suspending the order of 5th respondent in C.No.2/RI- DSW/KDP/2020, dated 12.02.2020 during pendency of main Writ Petition and to pass such other order or orders as Hon'ble court may deem fit and proper in the circumstances of the case..…” 2. When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that they have given 2+2 PSOs, security to the petitioner. 4 3.
