Petitioner, who is the owner of land bearing Khasra No. 802/3 kh area 0.020 hect. situated at village Ranpota, P.H.No. 33, Chhapora Tahsil Malkharouda, District Sakti, is seeking direction to the respondents towards payment of compensation stating that the land of petitioner has been used for construction of Basantpur-Parsada-Ghoghari road, however, no compensation has been paid till date. 2. Learned counsel for petitioner would submit that on the application for demarcation, the demarcation has been conducted by the revenue PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 authority vide page no. 10 of the petition, in which it has been found that some part of the land of petitioner has been used for construction of Basantpur-Parsada-Ghoghari road, however, no compensation has been paid by the respondents till date. 3. Learned counsel for respondents-State submits that Respondent No. 4/ Land Acquisition Officer/ SDO(R) will verify the position by making spot inspection of the land of petitioner and if it is found that the land of petitioner has been used for construction of Basantpur-Parsada-Ghoghari road then necessary steps shall be taken in accordance with law for acquisition of the land in question. 4. I have heard learned counsel for both the parties and perused the pleadings as well as panchnama report enclosed at page No. 10 of the writ petition. 5. From perusal of panchnama report, it appears that some part of the land of petitioner has been used for construction of Basantpur-Parsada- Ghoghari road, however, no compensation has been paid to petitioner till date. 6. In view of the above submission made by learned State counsel, Respondent No. 4/ SDO(R)-cum-Land Acquisition Officer is directed to make spot inspection of the land of petitioner to ascertain whether the said land has been utilized for construction of Basantpur-Parsada- Ghoghari road or not and if it is found that the land of petitioner has been used for construction of road then the respondents shall take appropriate steps for acquisition of land of petitioner in accordance with law, spot inspection be made within a period of 50 days from today. Petitioner is at liberty to apprise Respondent No. 4/ SDO(R) about the order passed by this Court. 7. With the aforesaid observation and direction, this writ petition stands disposed of.
