CORAM: HON’BLE MR JUSTICE RAJESH SEKHRI, JUDGE O R D E R 27.12.2025 Mr. Younis Ahad, leaned counsel for the petitioner, seeks to withdraw the present petition, with liberty to approach the appellate authority, in terms of Section 7 of J&K Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997, to prefer an appeal against the impugned order dated 28.02.2025, passed by Additional Deputy Commissioner Tral, vide which petitioner has been directed to vacate land, adjoining House No.281, located near Bata Naag Tral-i-Payeen. His statement is taken on record. In view of statement made by learned counsel for the petitioner, present petition is dismissed as withdrawn with liberty to the petitioner to file a statutory appeal within two days from today and appellate authority may consider prayer of the appellant, for interim relief as per law.
