1. Heard Mr. M.U. Mondal, the learned counsel for the petitioners. Also heard Mr. M.P. Goswami, the learned Additional Public Prosecutor appearing for the State of Assam.
2. The learned counsel for the petitioners has submitted that the petitioner were granted interim anticipatory bail by this Court, by order dated 11.04.2025, and in pursuant to the directions of this Court, the petitioners have appeared before the Investigating Officer and have co- operated in the investigation.
3. On the other hand, the learned Additional Public Prosecutor has produced the Case Diary of South Salmara P.S. Case No. 189/2024 and has opposed the prayer for making the interim anticipatory bail absolute on the ground that there are sufficient incriminating materials against the petitioners in the Case Diary, however, he submits that the petitioners have appeared before the Investigating Officer and their statement has been recorded.
4. I have considered the submissions made by the learned counsel for both the sides and have perused the Case Diary of South Salmara P.S. Case No. 189/2024, though there are sufficient incriminating materials against the present petitioners in the Case Diary, however, as they have complied with the directions of this Court and have co-operated in the investigation, hence, this Court is of the considered opinion that further
Page No.# 3/3 custodial interrogation of the petitioners may not be necessary for fair completion of the investigation.
5. Hence, the interim anticipatory bail granted to them, by order dated 11.04.2025 is hereby made absolute, subject to condition Nos. (ii) and (iii) attached to the said order, remaining intact.
6. This anticipatory bail application is accordingly disposed of.
7. Send back the Case Diary.
