Neutral Citation No. - 2025:AHC:24223-DB Court No. - 29 Case :- WRIT - C No. - 36136 of 2024 Petitioner :- Anand Pal Singh Alias Anang Pal Singh Respondent :- State Of Up And 5 Others Counsel for Petitioner :- Rajat Agarwal,Vikash Kumar Counsel for Respondent :- Bal Mukund,C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J. Petitioner wants this Court to direct the respondents to conclude the special audit pursuant to order dated 21.1.2016. An objection is taken to the maintainability of the writ petition on the ground that petitioner has no locus to intervene. Admittedly the grievance of the petitioner is in respect of alleged irregularities in the payment of old age women pension scheme. The petitioner is not an applicant nor is a beneficiary. It is asserted the petitioner's son, however, was a contractual employee working in the department and he has been murdered. Merely because petitioner's son was engaged as a contractual employee would not be sufficient basis to vest locus in the petitioner to challenge the issues. The petition otherwise is not filed in public interest. In the absence of any locus in the petitioner to intervene we decline to entertain the present writ petition which is, accordingly, consigned to records. Dismissal of this petition, however, will not preclude the appropriate authorities of the State to examine the allegations on its own merits and in accordance with law.
