KAJALGAON CHIRANG ASSA Advocate for the Petitioner : MS B BORA, MR. M BORAH Advocate for the Respondent : PP, ASSAM, MR J DAS (R-2) Page No.# 2/3 BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA ORDER 05.06.2025 Heard Mr. M. Borah, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor, Assam. Also heard Mr. J. Das, learned counsel representing the respondent no. 2/informant. This is an application filed under Section 482 of the BNSS, 2023 by the petitioner, namely, Sri Bhaben Sutradhar, praying for pre-arrest bail in connection with Kalaigaon P.S. Case No. 38/2015. The informant has alleged in the FIR that her 15 (fifteen) years old daughter was induced by the petitioner to come to his house where he had sexual intercourse with her on many occasions. The victim girl, in her statement, recorded under Section 183 of the BNSS also implicated the present petitioner. Mr. Das, learned counsel for the informant has submitted that the informant and the victim girl have settled the dispute with the petitioner. I have considered the submissions made by the learned counsel for both the sides. Since the dispute has been settled between the parties, this court is of the opinion that nothing would be achieved by keeping this application pending. Therefore, it is hereby directed that in the event of arrest of the petitioner, namely, Sri Bhaben Sutradhar, in connection with Kalaigaon P.S. Case No. 38/2015, the arresting authority shall release him on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the arresting authority.
