2
THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 6719/2025
ORDER:
This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 4th respondent in disposing of 1st petitioners’ representations dated 20.11.2024 and 06.01.2025 as illegal arbitrary and consequently direct the 4th respondent to dispose of my representations and mutate my name in online web land portal and pass such other order.”
2. The case of the petitioners in brief is that the petitioners are the absolute owners of the land admeasuring to an extent of Ac.0.11 cents in survey No.563/A and an extent of Ac.0.24 cents in Sy.No.563/1B in Railway Kodur Village, Railway Kodur Mandal, Annamaya District. The 1st petitioner made representations dated 20.11.2024 and 06.01.2025 to the 4th respondent seeking to remove the petitioners’ subject lands from the dispute register and mutate their names in the revenue records. But till date, the 4th respondent did not consider the same. Hence, the present Writ Petition. 3. Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents
4. Though the petitioners made several allegations against the respondents, during hearing, learned counsel for the petitioners
3
requested this Court, without touching the merits of the case, to issue a direction to the respondents to dispose of the representation dated 06.01.2025 submitted by the 1st petitioner to respondent No.4. 5. Learned Government Pleader for Revenue readily agreed to dispose of the representation dated 06.01.2025 submitted by the 1st petitioner before respondent No.4, pending with the authorities, within a reasonable time. 6. In view of the submission of the learned Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition.
This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioners himself requested to issue a direction to dispose of the representation dated 06.01.2025, this Court find no other alternative except to issue such direction. 7. In the result, the writ petition is disposed of, directing the respondents to consider and dispose of the representation dated 06.01.2025, after providing opportunity of hearing to both the parties,
