Rejoinder affidavit filed on behalf of the petitioner in Court today is taken on record. 2. Heard learned counsel for the parties and perused the record. 3. The instant writ petition has been filed for following relief: "i. Issue a direction commanding the Civil Judge (Senior Division) Fast Track Court, Pilibhit to adjudicate/decide the Execution Case No. 13 of 2023 (arising out of Original Suit No. 35 of 2009); Sandeep Puri and Another vs. Purva Madhyamik Vidyalaya Dori Lal Bheemsen and others, expeditiously, in a fixed time frame as this Hon'ble Court may deem fit to fix, without granting unnecessary adjournment to the parties." 4. Contention of the learned counsel for the petitioners is that the aforementioned case is pending since 2023 for adjudication. He prayed that the same may be decided expeditiously. 5. No useful purpose would be served in keeping this petition pending. 6. The present petition stands disposed of finally with a direction to the Civil Judge (Senior Division) Fast Track Court, Pilibhit to consider and decide the aforementioned case of the petitioner, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned and after giving a reasonable opportunity of leading evidence in respect of their case provided that there is no other legal impediment.
