1. Heard learned counsel Mr. M. I. Hussain for the petitioner Rofikul Sahab, who has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for transit anticipatory bail as he is willing to appear before the Siliguri Cyber Crime Police Station and co-operate with the

The petitioner is apprehending arrest in connection with Siliguri Cyber Crime Police Station Case No. 09/2025 under Sections 319(2)/318(4)/61(2)/111 of the Bharatiya Nyaya Sanhita, 2023. 3. Heard Ms. N. Das, learned Additional Public Prosecutor for the respondent State. 4. It is submitted on behalf of the petitioner that the petitioner is not at all involved in any trading apps like Yes Security and Aditya Birla trading app. This is a case regarding fraudulent transaction through two trading apps i.e., Yes Security trading app and Aditya Birla trading app. The informant who according to documents has earned profit through the trading apps was not allowed to withdraw his profit by the miscreants dealing with the aforementioned trading apps. 5. Time and again, the informant has asked for withdrawal of his profit earned through investment, but he was asked to pay commission and finally, the informant was impelled to lodge the FIR. 6. I have considered the submissions at the bar. 7. It is submitted on behalf of the petitioner that the petitioner is a school dropout and he is not aware of such trading apps. His cousin, i.e., Alamgir Bhuiya @Bablu, took his documents like voter ID, pan card, adhaar card and signed papers on 4.12.2025, with assurance to provide him a job at Satabari, Bamunigaon, Boko, and thereafter, his cousin received these documents and now the petitioner has been served with a notice to appear before the Siliguri P.S.
8. It appears that as the petitioner is willing to cooperate with the
Page No.# 3/3 investigation, interim transit bail may be granted to the petitioner.
The petitioner is directed to appear before the I.O. of Siliguri P.S., within 3(three) weeks from today and cooperate with the investigation and the petitioner is enlarged on interim bail of Rs. 30,000/- with a suitable surety of like amount to till
01.05.2025. Within 01.05.2025, the petitioner shall appear before the Siliguri Cyber Crime Police Station and co-operate with the investigation. This protection is granted only upto 01.05.2025 so as to enable the petitioner to approach the competent Court for seeking appropriate relief. 9.
