Mr. Lokendra Dobhal, Advocate for the applicant. Mr. S.S. Chauhan, Deputy Advocate General and Mr. Vikas Uniyal, Brief Holder for the State of Uttarakhand. 2. This first bail application has been moved by the applicant seeking regular bail in Case Crime/F.I.R. No.16 of 2024, under Section 8/20 of N.D.P.S. Act, registered at Police Station Kalsi, District Dehradun, on 16.03.2024. 3. It is contended by learned counsel for the applicant that applicant has falsely been implicated in the instant crime; has no criminal history and is languishing in jail since 17.03.2024. Learned counsel for the applicant submits that proper compliance of provisions of N.D.P.S. Act has not been made, inasmuch as, no inventory was made. He submits that applicant is the only bread earner in the family and, due to his detention, his entire family is at the verge of starvation. He submits that in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel vehemently opposed the bail application. Learned State Counsel was granted time to verify whether any inventory was made or not. Today, on instructions, learned Deputy Advocate General fairly submits that no 2025:UHC:3391 inventory of the seized contraband was made. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Bhagat Ram be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
