Contention of the learned counsel for the applicant is that false recovery has been shown against the applicant and on the basis of that recovery applicant has been falsely implicated in the present case. It has been further submitted that all the offence are punishable upto 7 years. Charge sheet has already been submitted, therefore, there is no requirement of custodial interrogation. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings. 4. On the other hand, learned A.G.A. for the State opposed the prayer for bail and submitted that applicant has criminal history of seven cases of similar nature and 12 bikes were recovered from the possession of the applicant. 5. Considering the aforesaid submissions and considering the fact that 12 stolen bikes were recovered from the possession of the applicant and subsequently those bikes were also identified by their respective owners who have lodged cases for stealing of their bikes and also considering that applicant has criminal history of 7
cases which are also of similar nature and from the bare perusal of the bail orders of the previous cases, it is clear that there was specific condition that applicant will not involve in any criminal case. However, the applicant after releasing on bail, kept on violating the condition of bail and remain involved in similar cases. 6.
Therefore, to prevent him to commit further offence and for ensuring his presence before the Trial Court in different cases, this Court is not inclined to grant bail to the applicant at this stage. 7.
