Grievance is that pond has been levelled and road is being constructed. 2. Once the land is recorded as pond, its nature cannot be allowed to be changed. 3. In the facts of the case, we call upon the respondents to file a specific affidavit disclosing the nature of the land and to restore such land to its original shape, in accordance with law. An affidavit in that regard will be filed by the respondent no.4, within two months. 4. List thereafter." Petitioner says he does not want to prosecute. 3. The writ petition is dismissed.
