The present application under Section 528 BNSS, has been filed for quashing the N.B.W. passed by learned Additional Chief Judicial Magistrate, Court No. 10, Moradabad on 02.01.2024 to 29.08.2024 as well as order dated 31.01.2024 in Case Crime no. 33 of 2014 (State of UP vs. Pramjeet Singh and others) under sections 18/20 of NDPS Act, Police Station Chandausi, District Moradabad as well as to stay the further proceedings of abovementioned case. 3. In pursuance to N.B.W., learned counsel for the applicant confined his prayer only for seeking time in favour of the applicant to appear before learned court concerned. 4. Per contra, learned A.G.A opposed the prayer. 5. Considering the innocuous prayer as made by learned counsel for the applicant, applicant is hereby directed to appear before the learned court concerned in pursuance to impugned N.B.W. order passed by learned Additional Chief Judicial Magistrate, Court No. 10, Moradabad on 02.01.2024 to 29.08.2024 within three weeks from today. 6. Till three weeks from today, no coercive action shall be initiated against the applicant in pursuance of Case Crime no. 33 of 2014 (State of UP vs. Pramjeet Singh and others) under sections 18/20 of NDPS Act, Police Station Chandausi, District Moradabad. After the expiry of aforesaid period of three weeks, learned concerned court is directed to proceed as per law. 7. With the aforesaid observation, the application is disposed of.
