Neutral Citation No. - 2025:AHC:24257-DB Court No. - 29 Case :- WRIT - C No. - 36667 of 2024 Petitioner :- Afzal Khan Respondent :- State Of Up And 8 Others Counsel for Petitioner :- Rafiuddin Ansari Counsel for Respondent :- Ahmad Saeed,C.S.C.,M. Asif,Om Prakash Ram Hon'ble Ashwani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J. Admittedly a civil suit has already been instituted by the petitioner in respect of his right over the immovable property where the petitioner claims to have secured an injunction also. Once that be so, for any action of disobedience the remedy of the petitioner would be elsewhere. All factual issues, as are sought to be raised, can otherwise be examined in the pending suit. A writ petition, therefore, would not lie for issuing a direction to the authorities to determine the question as to on which plot the petitioner is in possession. The writ petition is, accordingly, dismissed. Order Date :- 19.2.2025 RA Digitally signed by :- RAZIQ ALI High Court of Judicature at Allahabad
