By way of instant petition, petitioner has prayed for grant of following substantive reliefs:
“a) That the respondent be directed to notionally fix the pay of the applicant from the date put into the cadre of Clerk instead of from the date of actual joining and the actual salary that become payable on the date of actual joining be released and the entire arrears may kindly be ordered to be released to the applicant with interest @ 18% p.a. b) That the impugned communication dated 27.10.2018 whereby the applicant has though been held entitled for placement as Jr. Assistant 16.07.2020 whereas the juniors have been placed in the year 2017 and 2018, may kindly be modified and the respondents be directed to place the applicant as Jr. Assistant from the date juniors have been placed as Jr. Assistant (i.e. w.e.f. 17.06.2015) with all consequential benefits.”

The initial appointment of petitioner was as Peon on daily waged basis w.e.f. 29.10.1993. His status was converted from daily waged Peon to daily waged Clerk w.e.f. 26.10.1995.

Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by a judgment passed by this Court in CWPOA No. 6376 of 2020, titled as, Liaq Ram Kashyap vs. State of H.P. & others, decided on 29.4.2024. He further submits that the petitioner shall be satisfied in case respondent No. 2 is directed to consider and decide the case of the petitioner in a time bound manner in light of the judgment (supra).

The prayer being innocuous is not opposed.

Accordingly, the petition is disposed of with directions to respondent No. 2 to consider and decide the case of the petitioner within a period of eight weeks, in light of
judgment in CWPOA No. 6376 of 2020, titled as, Liaq Ram Kashyap vs. State of H.P. & others, decided on 29.4.2024. Needless to say that in case the petitioner is found similarly situated, as the petitioner in CWPOA No. 6376 of 2020, he shall also be granted the benefits as have been granted to the petitioner in CWPOA No. 6376 of 2020. Pending miscellaneous applications, if any, also stand disposed of.

The petition stands disposed of in the aforesaid terms, so also the pending miscellaneous application(s) if any.
