JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 4 10-12-2025 Heard learned counsel for the petitioners as well as the learned APP for the State. 2. The petitioners apprehend their arrest in connection with Bhawanipur P.S. Case No. 58 of 2025 registered for the offences punishable under Sections 127(1), 115(2), 118(1), 303(2), 352, 351(2), 109, 3(5) of the BNS. 3. The prosecution case, in brief, as per the written report of the informant Sunil Kumar Chaudhary is that on 09.03.2025 at about 10:00 PM, due to previous enmity, the accused persons allegedly assembled outside the house of the Patna High Court CR. MISC. No.39109 of 2025(4) dt.10-12-2025 2/3 informant and abused him as well as his family members. When the informant's wife objected, all the accused persons, armed with iron rod, lathi and danda allegedly assaulted her. It is further alleged that petitioner no. 3 bit the right cheek of the informant’s wife causing bleeding and petitioner no. 1 snatched her gold earrings. Petitioner no. 2 is alleged to have assaulted the informant’s sister on her head with iron rod, while petitioner no.1 also attacked the informant with a dabiya, causing head injury and Petitioner no. 2 allegedly took Rs. 25,000/- from his pocket. On alarm, neighbours arrived and rescued them. Petitioner no. 5 allegedly extended threats of dire consequences. 4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They are the persons of clean antecedents. Both the parties are agnates and the injuries are simple in nature. 5. On the other hand, the learned APP for the State has opposed the prayer for bail. 6. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Patna High Court CR. MISC. No.39109 of 2025(4) dt.10-12-2025 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Bhawanipur P.S.
