According to petitioner, her husband, who was registered with Uttarakhand Building and Other Construction Workers Welfare Board passed away on 01.09.2020. Petitioner applied for benefit available to construction workers, by making an application on 20.07.2021, but no decision thereupon has been taken. 5. Mr. Rahul Consul, learned counsel appearing for respondent no. 2, however, submits that there is no clarity regarding date of petitioner making application, as in the affidavit enclosed with the writ petition, the date mentioned is 11.06.2025; while, in the application, alleged to have been made, the date is 20.07.2021. He submits that as per provision contained in Rule 278 of the Uttaranchal Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2005, death assistance has to be provided to construction workers. 6. Having regard to the fact that petitioner’s husband, who was a 2025:UHC:7695 construction worker, died on 01.09.2020 and petitioner has allegedly made application for benefit under Rule 278, therefore, the writ petition is disposed of by permitting petitioner to submit fresh online application and also furnish necessary documents in the online portal of the Board, within ten days from today. If petitioner makes such application within ten days, the Board shall examine petitioner’s claim and pass appropriate order, as per Rule 279, within two months from the date of petitioner submitting online application.
