In pursuance of the direction passed by this Court dated 17.07.2025, a report is submitted by the Inspector-in-Charge, Gazole P.S., Malda, which is handed over by the learned advocate for the State during course of hearing. 4. 19.09.2024. As the appellant/convict no. 1, Bikhu Mondal, has already been expired, the instant appeal stands abated against him. 5. It is told by the learned advocates for the parties that the paper books in connection with this case have already been handed over to them. 6. The case is otherwise ready for hearing. 7. Let the matter appear in the list two weeks after reopening of this Court following ‘puja vacation’. In Re: CRA 254 of 1989
8. Both the parties are represented by the learned advocates. 9. In pursuance of the direction, a report is submitted by the Inspector-in-Charge, Gazole P.S., Malda, which is handed over by the learned advocate for the State during course of hearing. 10. The said report indicates that during pendency of this appeal, the sole appellant/convict, Debu @ Deven Rajbangshi, has expired during pendency of this appeal on 09.10.2023. 11. A photocopy of certificate of death of the said appellant/convict, Debu @ Deven Rajbangshi, has been collected and tagged with the said report, which also affirms the death of the said appellant/convict. 12. As the sole appellant/convict has been expired during pendency of this appeal, the instant appeal stands abated against him. 3
13. Accordingly, the instant appeal be and same is hereby dismissed as abated. 14. Let the report submitted by the Inspector-in-Charge, Gazole P.S., Malda, be kept with the record. 15. Urgent Photostat Certified Copy of the order, if applied for, be given to the parties upon complying with all legal formalities.
