SREENIVASA REDDY Criminal Petition No.2589 of 2025 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioner herein, to grant anticipatory bail in connection with Crime No.147 of 2024 of Veldurthi Police Station, Kurnool district, registered for the offence punishable under Section 194 of the Bharatiya Nagarik Suraksha Sanhitha, 2023. 2. Case of the prosecution, in brief, is that on 15.10.2024 at about 19.00 hours, wife of the deceased Dama Kesava Rao gave a report to police alleging that on 14.10.2024, at about 13.30 hours, at S. Perivemulua road near Cheruvu at the outskirts of Guntupalli village, Veldurthy Mandal, her husband committed suicide by consuming pesticide poison, as his relatives namely Ramanjaneyulu, Swapna and Saraswati, who took money from the deceased, have not returned the same in spite of repeated requests. 3. Heard. Perused the record. 2 4. The present case has been registered for the offence punishable under Section 194 of the BNSS with certain allegations as against the petitioner herein and others. Learned counsel for the petitioner submits that the police are trying to alter the said section of law and arrest the petitioner herein at any point of time. On the other hand, learned Assistant Public Prosecutor submitted that the police are investigating the case and they have not altered the provision of law till today, hence the question of granting anticipatory bail does not arise. 5. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to entertain the bail application. 6. However, since the petitioner apprehends that the police may alter the section of law and arrest him at any point of time, this Court directs the respondent-police to issue 48 hours’ prior notice to the petitioner herein before taking any coercive action against him in the crime vide FIR No.147 of 2024 of Veldurthi Police Station, Kurnool district. 7. With the above direction, the Criminal Petition is disposed of. 3 As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _______________________ __ JUSTICE K.
