Neutral Citation No. - 2025:AHC:36455 Court No. - 4 Case :- WRIT - A No. - 16852 of 2024 Petitioner :- Vinod Kumar Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Kunwar Abhishek Singh,Suresh Pratap Singh Counsel for Respondent :- C.S.C.,Deepak Gaur Hon'ble Ajit Kumar,J. 1. An objection has been raised by Sri Deepak Gaur, Advocate who is a panel counsel of the Gram Panchayat concerned that his signatures have been forged upon memo of petition showing service of the petition upon him, whereas, no such copy of the petition was ever served upon him as the concerned Clerk of the counsel never visited him and when he enquired about the petition from the counsel on his personal cellphone number, he was informed that the copy had already been served in the office of the Chief Standing Counsel. 2. This is a serious issue. If a counsel has not been served with copy of petition by Clerk of a counsel who was required to serve a copy upon the panel counsel then lawyers should not defend such Clerks and should not take a stand that since a copy was served in the office of Standing Counsel, he was not required to serve it again. 3. At this stage, learned counsel for the petitioner states that he may be permitted to withdraw this petition. 4. Sri Gaur has no objection provided directions are issued that whenever the next petition is filed by the present petitioner, copy of the same shall be served in advance upon Sri Gaur. 5. In view of the above, this petition is permitted to be withdrawn with liberty to file afresh, however, when the next petition is filed, copy thereof shall be served upon Sri Gaur, the panel counsel of the Gram Panchayat concerned in advance.
