Petitioners were engaged on contract as Lecturer in Government Post Graduate College, Lohaghat, District Champawat. According to them, their salary for the period from 07.01.2020 to 08.02.2020 has been arbitrarily withheld. Thus feeling aggrieved, petitioners have approached this Court, seeking following relief: “I. To issue a writ, order or direction in the nature of mandamus commanding and directing the respondent authorities to forthwith release the deducted salary of the petitioners for the period of 7th January 2020 to 8th February 2020 which has been illegally deducted by the respondent No. 3.” 3. A counter affidavit has been filed by Mr. S.S. Tripathi, Deputy Secretary, Higher Education Department, in which it is alleged that petitioners remained unauthorisedly absent between 07.01.2020 to 08.02.2020; therefore, their salary for the said period was not paid. 4. Be that as it may, since petitioners have sought a writ of mandamus, we are of the view 2025:UHC:4836-DB that ends of justice would be met if they are permitted to make a representation to the competent authority. 5. Accordingly, writ petition is disposed of with liberty to petitioners to make representation to the Principal of the concerned college.
