JUSTICE MRIDUL KUMAR KALITA ORDER 08.08.2025 1. Heard Mr. N.N.B. Choudhury, the learned counsel for the applicant. Also heard Ms. M. Deka, the learned counsel for the NCB. 2. This interlocutory application has been filed by the applicant, namely, Sri Kamal Kant Ray in connection with bail application No. 1080/2025 praying for modification of one of the condition of the bail application granted to the applicant. 3. The learned counsel for the applicant has submitted that the Page No.# 3/4 applicant was allowed to go on bail, by order dated 24.04.2025, passed in Bail Application No. 1080/2025 by this Court with certain conditions. That condition No. vii. attached to the said order is as follows:- “vii. That the petitioner shall appear before the Officer-In-Charge of NCB Crime No. 10/2023 once in every fortnight till the pendency of the NDPS Case No. 43/2023.” 4. The learned counsel for the applicant has submitted that the aforesaid condition has become onerous for the applicant as he is suffering from osteoarthritis of the knee and it has become difficult on his part to report to the Officer-in-Charge of NCB once in every fortnight due to medical reasons. 5. The learned counsel for the applicant however submits that the applicant is fully co-operating in trial and is regularly appearing before the Trial Court and also abiding by all other conditions imposed by the said bail order. 6. The learned counsel for the NCB Ms. M. Deka, has submitted that considering the fact applicant is co-operating in trial, and has shown medical reasons for modification of the said bail condition, she does not have any objection to the said prayer. 7. Considering the submissions of the learned counsel for both sides, this Court is also of the considered opinion that Condition No. vii attached to the bail order dated 24.04.2025, passed in Bail Application No. 1080/2025 has become onerous for the applicant and therefore, Page No.# 4/4 the same shall be treated as removed from the conditions imposed by the aforesaid bail order. 8.
