A preliminary objection has been raised by Sri Abhishek Shukla, learned Additional Chief Standing Counsel, as to the maintainability of the writ petition on the ground that order impugned is appealable under Section 67(5) of the U.P. Revenue Code, 2006. 2. In view of the said fact, the writ petition is dismissed on the ground of alternative remedy. 3. However, in case the petitioner prefers an appeal within 15 days from today, the appellate authority shall not go into the question of limitation and shall decide the same strictly in accordance with law. 4. Registry is directed to return certified copy of the impugned order to the petitioner's counsel within 48 hours.
