The instant writ application has been preferred for following reliefs: (i) For a direction upon the respondents to consider the case of the petitioner for promotion on the post of ‘Havildar Driver’ with all consequential benefits w.e.f the year 2016 i.e. the year from when the batch mates of the petitioner have been promoted on the post of ‘Havildar Driver’. (ii) After consideration of the case of the petitioner for promotion on the post of ‘Havildar Driver’ w.e.f the year 2016 with all consequential benefits, the respondents may be further directed to grant and confer the seniority/notional seniority to the petitioner in the state wise seniority list of the ‘Havildar Drivers’ from the date his batch mates were considered and promoted on the post of ‘Havildar Driver’.

Learned counsel for the petitioner submits that though he is entitled for claim as prayed but the respondents are sitting tight over the matter. As such, he prays that instant application may be
disposed of by directing the respondents to look into the matter and redress the grievance of the petitioner.

Learned counsel for the respondents submits that since no counter-affidavit has been filed, as such, the petitioner may be
directed to approach the respondent No.2 for redressal of his grievances.

Having regard to the limited submissions of learned counsel for the petitioner, the instant application is hereby disposed of by directing the respondent No.2 to treat this writ application as representation and take a decision in the matter in accordance with law and applicable rules and regulations, by passing reasoned and speaking order within a period 12 weeks from the date of receipt of a copy of this order. Learned counsel for the petitioner is directed to serve a copy of this writ application along with a copy of this order for early disposal of the claim.
5. It goes without saying that if the petitioner is found entitled for the benefit as claimed, the same shall be extended to him within a further period of four weeks.
6. With the aforesaid observations and directions, the writ petition stands disposed of.
