Case of the prosecution is that this is a case of cheating with criminal conspiracy and opening a gaming house by violating Andhra 2. Pradesh Gaming Act. Learned counsel for the petitioner would submit that on the date of alleged incident itself the petitioner suffered with a fracture to his both legs and he needs surgery. As suggested by the doctor, he may be on bed for the next four months. Learned Assistant Public Prosecutor vehemently opposed the prayer of the petitioner for grant of anticipatory bail. Learned Assistant Public Prosecutor would submit that it is a case of cricket betting and as many as nine witnesses were examined and charge sheet is not filed in this matter and the investigation is at crucial stage. Considering the submissions made and on perusal of the material on record, it is seen that investigation in the present crime is not concluded. As submitted by the learned counsel for the petitioner, the petitioner herein suffered fractures to both legs and he needs surgery and he will be on the bed for the next four months as suggested by the doctor and hence, this Court is of view that the immediate threat of arrest does not arise in this matter. 7.
