Neutral Citation No. - 2025:AHC:48712 Court No. - 5 Case :- WRIT - A No. - 16926 of 2024 Petitioner :- Dr Bhagyasree S And 3 Others Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Adarsh Singh,Indra Raj Singh Counsel for Respondent :- A.S.G.I.,Ashish Kumar Ojha,Vivek Kumar Singh Hon'ble Ajay Bhanot,J. Heard Shri Adarsh Singh, learned counsel for the petitioner, Shri Ashish Kumar Ojha, learned counsel for the respondent nos. 2 and 3 and Shri Vivek Kumar Singh, learned counsel for the respondent no.1. The petitioners claim that they are entitled to the benefit of services rendered by them as Assistant Professors in another institution for purposes of promotion to the post of Associate Professors. The petitioners have made representation in this regard but to no avail. The only prayer made on behalf of the petitioners is that representation of the petitioners may be decided within a stipulated period of time. Shri Ashish Kumar Ojha, learned counsel for the respondent nos. 2 and 3 and Shri Vivek Kumar Singh, learned counsel for the respondent no.1 submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent no. 2 is directed to decide the representation of the petitioner regarding grant of promotion after considering all relevant facts including applicable provisions of law, seniority, service records and relevant service rules as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 5.4.2025 Saurabh Digitally signed by :- SAURABH High Court of Judicature at Allahabad
