This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 77/2024 registered at Police Station Ramanujganj, District- Balrampur-Ramanujganj(C.G.), for the offence punishable under Section 20(B) of N.D.P.S. Act. 2. The earlier bail application of the applicant being MCRC No. 5232/2024 was rejected by this Court vide order dated 16.08.2024 on merits. 3. The prosecution story in brief, is that, as per secret information received from the informant, on the basis of such information, the police ofÏcials PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.04.29 10:44:06 +0530 2 conducted raid and have seized 05 Kgs. from the present applicant. Thereafter, the crime has been registered against the applicant. 4. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and he is in jail since 14.04.2024. He would further submits that in compliance of the Court’s order dated 18.03.2025, the Police Personnel who was the prosecution witnesses has appeared before the trial Court and evidence has been recorded and the trial is fixed for final argument on 01.05.2025. 5. On the other hand, learned State counsel would oppose the bail application and submit that this Court already rejected the bail application of the applicant vide order dated 16.08.2024 on merits. As such, he is not entitled for grant of bail. 6. Considering the fact that in compliance of the Court’s order dated 18.03.2025, the Police Personnel who were the prosecution witnesses has appeared before the trial Court and evidence has been recorded and the trial is fixed for final argument on 01.05.2025. Accordingly, the bail application of the applicant - Munna Kumar Gupta, filed under Section 483 of BNSS, involved in Crime No. 77/2024 registered at Police Station Ramanujganj, District- Balrampur-Ramanujganj(C.G.), for the offence punishable under Section 20(B) of N.D.P.S. Act, is rejected. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
