This writ petition has been filed with the prayer to direct the respondent no.2 to compensate the petitioner for illegal demolition of construction made by petitioner on his plot no.596-Ka, area 0.008 hectare, situated at Village Mawai, Pargana Atharwal, Tehsil Manjhanpur, District Kaushambi. Taking cognizance of such grievance we invited instructions from the respondents. Instructions of the revenue authorities are furnished, which are signed by Sub-Divisional Officer, Tehsildar and Naib Tehsildar, according to which none of the constructions of the present petitioner has been demolished. It is pointed out that the constructions demolished belongs to one Sanjay Kumar son of Ramsukh. The specific stand of the respondents is that no construction on petitioner's land of Plot No.596M Area 0.006 hectare has been demolished. Once that be so, no direction can be issued for payment of compensation. In the event petitioner makes any factual issue, his remedy would be to approach the competent civil court.
