Neutral Citation No. - 2025:AHC:69516 Court No. - 4 Case :- WRIT - A No. - 16700 of 2024 Petitioner :- Ashutosh Kumar Respondent :- State Of U.P. & 3 Others Counsel for Petitioner :- Pradeep Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Pradeep Kumar Singh, learned counsel for the petitioner and learned Standing Counsel for the State respondents. In compliance of earlier order of this Court learned Standing Counsel has obtained instruction in the matter and as per the instruction petitioner has been served with chargesheet on 28th February, 2025 and final inquiry report has also been supplied to the petitioner with show cause notice on 30th April, 2025. In such circumstances, therefore, I do not find any justification to interfere with the suspension order dated 19th July, 2024 instead the Court finds it appropriate to direct for final decision to be taken in the matter of disciplinary proceedings as petitioner has already been served with the final inquiry report. Let an appropriate decision be taken by the disciplinary authority strictly in accordance with law by following the procedure prescribed for under the relevant Uttar Pradesh Government Servant (Discipline and Appeal), Rules, 1999 and also in the consonance with principles of natural justice within a maximum period of one month from the date of production of certified copy of this order. Petitioner is permitted to furnish his reply to the show cause notice if already not furnished within a week from today. However, it is clarified that despite the cooperation and submission of reply by the petitioner to the show cause notice, final decision is not taken by the disciplinary authority, the order of suspension dated 19th July, 2024 shall be revoked and petitioner shall be entitled to the reinstatement in service and shall be paid salary. With the aforesaid observations and directions, this petition stands
disposed of.
