This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 200/2024 registered at Police Station - Tikrapara, District – Raipur, (C.G.), for the offence punishable under Section 20(C), 29 of Narcotic Drugs and Psychotropic Substances Act. 2. The earlier bail application of the applicant being MCRC No. 4028 of 2024 was rejected by this Court vide order dated 24.07.2024 on merits. RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN 2 3. Case of the prosecution, in brief, is that on 13.03.2024, on the basis of secret information received from an informant, two primary accused persons namely Rishabh Sharma and Aditya Singh were arrested for jointly carrying 21.400 Kg of cannabis (ganja) and the offence of 20(C) & 29 of the NDPS Act is registered against Rishabh Sharma and Aditya Singh in Crime No. 200/2024. Subsequently, on 15.03.2024, on the basis of memorandum statement of the said two primary accused persons, additional cannabis (ganja) weighing 13.3 Kg was separately seized from the joint possession of Chandra Kumar Ratre (the Applicant) and other co-accused person namely Ashish Mishra from the auto rickshaw bearing registration No. CG- 4-PA- 0130. Therefore, the applicant was subsequently arrayed as one of the accused persons in the said Crime no. 200/2024 for the offence under Sections 20(C) & 29 of the NDPS Act. Thereafter, the crime has been registered against the applicant. 4. Learned counsel for the applicant would submit that from the joint possession of the applicant and other co-accused person namely Ashish Mishra, i.e. 13.300 Kg Ganja was recovered and the applicants have been falsely implicated in this case and the present applicant is in jail since 15.03.2024. She also submits that the quantity of contraband article which has been recovered from the present applicant and other co-accused person namely Ashish Mishra is less than commercial quantity and further the facts that in the present case, charge-sheet has been filed before the competent Court and the conclusion of the trial may take quite long time. 3 Accordingly, she prays for enlarging the applicant on regular bail. 5. On the other hand, learned State counsel opposes the bail application of the present applicant. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From perusal of the pleadings, it appears that no new ground has been raised in this second bail application. Thus, I do not find any good ground for grant of bail, hence, this second bail application of the present applicant is rejected. 8. Accordingly, the bail application of the applicant – Chandra Kumar Ratre, involved in Crime No. 200/2024 registered at Police Station - Tikrapara, District – Raipur, (C.G.), for the offence punishable under Section 20(C), 29 of Narcotic Drugs and Psychotropic Substances Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
