(2) According to petitioner, he is serving as Peon in Revenue Department in District Uttarkashi for the last more than 28 years, however his claim for regularisation has not been considered so far. By means of this writ petition, petitioner has sought the following reliefs: “I. To issue a writ order or direction in the nature of Mandamus commanding and directing the respondents to consider the case of petitioner for regularisation against class IV post considering his past continuous service since year 1997. II. To issue a writ order or direction in the nature of Mandamus commanding and directing the respondents to pay the minimum of pay scale of Class IV post to petitioner till the time his regularization is considered by the respondents.” (3) Learned State Counsel submits that from the pleadings made in the writ petition, status of the petitioner is not clear. He submits that it is not known whether the petitioner was engaged through outsourcing or whether there is master-servant relationship between the State Government and the petitioner. (4) Having regard to the facts of the case, writ petition is disposed of by 2025:UHC:7535 permitting the petitioner to make representation, staking his claim for regularisation. If petitioner makes representation within three weeks, District Magistrate, Uttarkashi shall look into the matter and take decision, as per law, within four months thereafter.
