Order on Board 03.03.2025 1 Heard Mr. Ishwar Jaiswal, learned counsel for the petitioners as well as Ms. Akanksha Verma, learned Panel Lawyer appearing for the State/respondents. 2 By way of this petition, the petitioners have prayed for following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondent authorities while deciding the representations (Annexure P-2) of the petitioners grant benefit of Third time pay scale. 10.2 That, the Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.” 3
Brief facts of the case, is that, the petitioners were retired from their services after completing more than 30 years of services and
3 their pension were fixed and other benefits were also granted, but the third time pay scale has not been granted as they had already completed more than 30 years of their services. Thereafter the petitioners were approached to the respondent department and submitted orally for grant of third time pay scale, but the same has not been granted, therefore, the petitioners have filed representations before the respondent department, which are still pending. 4
Learned counsel for the petitioners submits that they are seeking a direction to the respondents to consider and decide their representations. 5 On the other hand, learned counsel appearing for the State/respondents submits that he is having no objection to the limited prayer made by learned counsel appearing for the petitioners. 6 On the basis of submission made by both the counsel for the parties, at this stage, without entering into the merits of the case, this writ petition is disposed of giving liberty to the petitioners to make detailed representations by each of the petitioner before the concerned respondent authorities raising all grounds as raised in this writ petition within a period of 10 days and, in turn, the concerned respondent authorities is directed to consider and decide the same within a further period of 30 days.
4 7 With the aforesaid observation and direction, this writ petition is
disposed of.
