This writ petition has been filed with the following prayer:- "1. issue a writ, order or direction in the nature of mandamus directing the respondent authorities particularly respondent no.3/Sub Divisional Magistrate, Jakhanian, Ghazipur to restrain the respondent no. 5 not to construct chak road on bhumidhari land of petitioner bearing Plot No.106 area 1.3240 hectare, which is situated in Village-Bakhara, Pargana- Shadiyabad, Tahsil-Jakhanian, District- Ghazipur. ii. issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 and 3 to inquire the matter and pass speaking and reasoned order on the applications dated 11.04.2024 and 11.07.2024 moved by the petitioner within stipulated and reasonable period." 2. It is contended by learned counsel for the petitioner that chak road has been constructed on the bhumidhari land of the petitioner by respondent No.5. Ventilating his grievance, an application has been moved by the petitioner on 11.4.2024 before respondent No.3, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent No.3 to decide the application dated 11.04.2024, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
