Petitioner has been made accused in connection with Serengdag P.S. Case No. 06 of 2023 for the offences registered under sections 147, 148, 149, 385 and 435 of the Indian Penal Code and section 17 of C.L.A. Act, and Charge has been framed under sections 147, 148, 149, 385, 435, 109 and 120B of the Indian Penal Code and section 17 of C.L.A. Act, pending in the court of Ms. Jaya Smita Kujur, learned Judicial Magistrate, 1st Class, Lohardaga. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.2271 of 2024 by order dated 23.04.2024 with a liberty to the petitioner to renew his prayer for bail after six months. On 05.06.2023 at about 1.20 a.m., members of M.C.C. group had set ablaze JCB Machine of the Informant near the house of Jokhan Kherbar. Suspicion was raised against Ravindra Ganjhu, Area Commander of the banned organization that he had committed the offence. It was submitted that the name of the petitioner had transpired in the confession of co-accused Sunil Kherwar @ Rajkumar Kherwar. It was further submitted that the house of the petitioner was raided from where naxal literature and prohibited arms were recovered. It was further submitted that petitioner is in custody since 19.08.2023. Considering the period of custody, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Ms. Jaya Smita Kujur, learned Judicial Magistrate, 1st Class, Lohardaga or her successor, in connection with Serengdag P.S.
