Applicant-Jalees Ahmad has filed this petition under Section 407 Code of Criminal Procedure for transfer of Sessions Trial No. 163 of 2024; titled State vs. Nadeem and other, arising out of Case Crime No. 275 of 2023, under Sections 498A, 323, 504, 304-B, 34 and 3/4 Dowry Prohibition Act, Police Station Dilari, District Moradabad pending before Additional Sessions Judge/F.T.C.-III, Moradabad to any other court of competent jurisdiction at Rampur. Learned counsel for the applicant prays for transfer of the trial from Moradabad to Rampur, as the accused persons-opposite party nos. 2 to 4 are threatening the applicant to compromise the matter. In this regard, he has drawn the attention of the Court to the application dated 29th July, 2024 addressed to the D.G.P., State of U.P. Lucknow. Concededly, the charges against the accused persons have not been framed, who are on bail, and no steps have been taken by the applicant to seek cancellation of the bail. The application dated 29th July, 2024 is lacking in material particulars relating to the alleged threats and contains a vague averment. The grounds raised for transfer of the case are not sufficient. Resultantly, the application fails and is hereby dismissed.
