(Oral) Applicant is in judicial custody in FIR No. 315 of 2023, under Sections 147, 148, 149, 307, 504, 506 IPC, Police Station Sitarganj, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. This is second bail application of the applicant. His first bail application rejected on merits on 06.05.2024. 4. It is argued that co-accused Harpreet Singh alias Happy Kahlo has already been granted bail. The applicant is not named in the FIR. He has not been named by witnesses, who have already been examined at trial. These are, in fact, injured witnesses; there is no other evidence against the applicant. 5. These facts are admitted by learned State counsel. 2 6 Having considered the entirety of facts, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
