1. This is an application for condonation of delay of 1538 days in filing the Appeal against the impugned Judgment dated 05-03-2021 and
Order of Sentence dated 05-03-2021, passed by the learned Special Judge, (POCSO), West Khasi Hills District, Nongstoin in Special POCSO Case No. 19 of 2016, whereby the applicant/appellant has been convicted under Section-5(l)(n)7 of the POCSO Act punishable under Section 6/8 of the Act ibid and under Section 506 IPC and under Section 6 of the POCSO Act, sentenced to undergo 20(Twenty) years of rigorous imprisonment, accompanied with a fine.
2. We have perused the application for condonation, and we are satisfied that sufficient cause has been made out in explaining the delay.
3. Mr. R.Gurung, learned GA for the respondent, also has no objection to the condonation, as prayed.
4. Accordingly, the prayer is allowed and the delay of 1538 days, is condoned. Registry to diarize and register the Appeal.
