Applicant has filed this application under Section 407 Cr.P.C. seeking transfer of Compliant Case No. 320 of 2023, titled Anita Devi Vs. Radhakrishna and others, under Sections 147, 323, 504, 506, 147, 149, 193, 452, 354, 384, 389 I.P.C., Police Station Rasulpur, District Firozabad, pending before the Additional Chief Judicial Magistrate-I, Firozabad to the court of competent jurisdiction at Moradabad Applicant being complainant had instituted a complaint at Firozabad, wherein the accused-opposite party nos.2 to 9 have been summoned and have been extended the concession of bail. Learned counsel for applicant prays for transfer of the subject case from Firozabad to Moradabad as the accused persons are threatening her. Learned counsel further submits that the applicant has now shifted to Moradabad, therefore, it is convenient for her to pursue the said complaint at Moradabad. After hearing the learned counsel for applicant and considering his submissions, this Court finds that the applicant never moved any application for cancellation of bail, if, they had threatened her. The averments in this regard are vague and without particulars. That apart, the convenience of one party alone cannot be construed as a valid ground for transfer of the case. The application is dismissed.
